These Terms of Service ("Terms") govern your access to and use of the FlightPack desktop application, websites, APIs, cloud-sync services, and related features (collectively, the "Service") provided by Upkeep Labs LLC ("FlightPack," "we," "us," or "our"). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
FlightPack is entertainment and training-support software for consumer flight simulators. It is not an approved aviation training device, electronic flight bag, navigation system, flight-planning authority, airworthiness tool, or substitute for instruction from a qualified aviation professional. Scores, callouts, airport or runway data, weather adjustments, coaching, and other analysis may be incomplete, delayed, or inaccurate.
Do not use the Service to operate, navigate, dispatch, maintain, or make safety decisions for a real aircraft. You are solely responsible for real-world aviation decisions and for following applicable laws, regulations, procedures, and simulator-network rules.
You must be legally capable of entering into these Terms. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms and supervise your use. You must provide accurate account information, protect your credentials, and promptly notify us of unauthorized access. You are responsible for activity performed through your account.
You may not sell, transfer, or share an account in a way that bypasses subscription limits or security controls. We may require email verification or other reasonable steps to protect the Service and its users.
FlightPack can record simulator sessions locally and may provide logbooks, telemetry, maps, scoring, debriefs, trends, achievements, sharing, cloud sync, restore, and other features. Available features depend on your platform, simulator, account status, subscription tier, feature flags, and software version.
We may add, modify, limit, suspend, or discontinue features, integrations, or compatibility. We do not guarantee that every simulator, aircraft, add-on, operating system, airport database, or third-party service will remain supported.
Some features require a paid subscription. Prices, billing periods, included features, trial terms, and promotional or founding-member offers are shown before purchase. Payments are processed by Stripe or another disclosed payment provider. You authorize recurring charges at the displayed interval until you cancel.
We may change future prices or plan features with reasonable advance notice. Promotional and founding-member pricing is subject to the conditions presented with the offer. Failed or disputed payments may result in loss of paid features without deleting your account.
You retain ownership of flight records, telemetry, notes, screenshots, feedback, and other content you submit or generate ("User Content"). Flight data can remain on your device, but account and cloud features transmit and store data as described in the Privacy Policy.
You grant us a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, display, and otherwise use User Content only as reasonably necessary to operate, secure, improve, and provide the Service, comply with law, and honor your sharing choices. This license ends when the content is deleted from our systems, subject to reasonable backup retention and legal obligations.
Sync and restore are convenience features, not backup guarantees or continuous two-way synchronization. Private flights upload automatically while you have an active Pro entitlement. If Pro ends, the private cloud archive remains browser-readable for 30 days and is then removed. Flights you deliberately publish remain available until you make them private or delete your account. Restore is a limited recovery flow rather than a conflict-resolving merge. Keep independent copies of data that matters to you. Connectivity failures, software defects, account deletion, or third-party outages may cause delay, duplication, corruption, or loss.
When you deliberately publish a flight, FlightPack creates a lightweight public copy that may include your username, a reduced route trace, aircraft and tail number, scores, events, and flight-plan details. Other sharing features, when available, may expose the content you select. Public information may be indexed, copied, or reshared by others. Changing an item back to private limits future access through the Service but cannot recall copies already made by other people or services.
You represent that you have the necessary rights to share your User Content and that it does not reveal another person's private information or violate law. We will not use an identifiable private flight in advertising without additional permission, but public content may appear as part of operating and promoting the public sharing feature itself.
You may not use the Service to:
The Service, including its software, design, scoring methods, branding, documentation, and content other than User Content, is owned by Upkeep Labs LLC or its licensors and protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use the desktop application with compatible flight simulators. You may not resell, sublicense, or commercially exploit the Service itself without our permission. Open-source components remain governed by their respective licenses.
If you send product ideas or suggestions, you grant us a perpetual, worldwide, irrevocable, royalty-free right to use those ideas without restriction or compensation. This does not transfer ownership of flight data, diagnostic attachments, or other User Content. Bug reports and attached diagnostics are processed to provide, secure, and improve the Service as described in the Privacy Policy.
FlightPack depends on third-party simulators, platforms, map or airport data, payment processing, hosting, authentication, analytics, crash reporting, and other services. Their terms and privacy practices may apply separately. FlightPack is not affiliated with or endorsed by simulator manufacturers, aircraft manufacturers, aviation authorities, or online flying networks unless expressly stated. We are not responsible for third-party services, data, outages, or changes.
You may stop using the Service, cancel a subscription, or delete your account using the available settings. Account deletion is permanent: it cancels associated service access and deletes account-linked cloud flights, telemetry, authentication records, and related cloud data from active systems. It does not erase the FlightPack SQLite database or other files on your devices; you must remove local data separately. We may retain limited billing, refund, fraud-prevention, security, backup, or legal-compliance records where reasonably necessary. Canceling a subscription does not delete your account or local data. Private cloud archives follow the 30-day post-Pro retention period described above, while flights you deliberately published remain until you unpublish them or delete your account.
We may limit, suspend, or terminate access if you violate these Terms, create risk or legal exposure, fail to pay fees, or threaten the integrity of the Service. Where practical, we will provide notice and an opportunity to remedy the issue. Sections that by their nature should survive termination—including ownership, licenses already required for public copies, disclaimers, and liability limits—will survive.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND DATA PRESERVATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR ANY REAL-WORLD AVIATION PURPOSE.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you. Nothing in these Terms limits non-waivable consumer rights.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPKEEP LABS LLC AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR USE, ARISING FROM OR RELATED TO THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
We may update these Terms as the Service or law changes. We will post the updated Terms and revise the date above. For material changes, we will provide reasonable notice through the Service, by email, or another appropriate method. Changes apply prospectively. If you do not agree to an update, you must stop using the Service and may cancel your subscription.
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service, except for additional terms presented for a specific offer or feature. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, financing, reorganization, or sale of assets. Neither party is liable for delay caused by events beyond reasonable control.
